All of the nine men were arrested and taken to the capital of Mississippi County jail in Scottsboro, Alabama. That night, a mob gathered alfresco the jail. But the Governor sent the National Guard in to protect the young men, who would become known as the Scottsboro Boys.

With only 72 hours left until the boys were scheduled for the electric car chair, the ILD argued to the Alabama haughty Court that the boys were denied a fair trial, no proper representation and that the comments of the public influenced the jury. When the Alabama Court disagreed, they took it to the Supreme Court who took sides with the ILD. The boys were given a New York Attorney, Samuel Leibowitz.

In March 1933, the Scottsboro boys began their second trial. Leibowitz began his trial by pointing out that the jury was racist because black people didn’t serve on the jury. The try denied the request for a mistrial.
